Contractual Documentation and GDPR – Nios4 Cloud

Welcome to the section containing the contractual documentation applicable to the access and use of the Nios4 Cloud services, including the activation of free trial accounts.

By using the Service, you acknowledge and accept the documents listed below, which together constitute a single, binding agreement between the Customer and D-One Software House, the owner of the Nios4 Platform.

Applicable Contractual Documents

1) Terms of Service – Nios4 Cloud

These Terms govern the access to, use of, and operational conditions of the Nios4 Cloud Service, including account management, service availability, limitations, suspension, and any applicable Service Level Agreements (SLAs).

2) Software License and Sales Terms – Nios4

These Terms govern the grant of the software license, applicable subscription fees, limitations, rights, and obligations relating to the use of the Nios4 software.

3) Data Processing Agreement (DPA) – Appointment as Data Processor (Article 28 GDPR)

This Agreement governs the processing of personal data carried out by D-One Software House on behalf of the Customer in connection with the provision of the Nios4 Cloud Service and constitutes a valid appointment as Data Processor pursuant to Article 28 of the General Data Protection Regulation (GDPR).

4) AI Transparency

Read the documentation describing how D-One Software House uses Artificial Intelligence systems within the Nios4 Platform and its related services. The document explains the purposes of AI usage, transparency principles, data protection measures, human oversight, and the information provided in accordance with the European Artificial Intelligence Act (AI Act).

Legal Effect and Online Acceptance

The documents listed above form an integral and essential part of the agreement governing the use of the Nios4 Cloud Service.

Acceptance is provided electronically, for example through a checkbox or equivalent mechanism during registration, purchase, or activation of a free trial, and produces legally binding effects between the parties.
